What is the Notice of Intent to Comply with Provincial Bill 13?
Density bonusing is a land use planning tool that provides the developer with the option to build to a higher density in exchange for providing amenities or affordable housing. The Province has updated legislation to require a more detailed and transparent approach to amenities obtained through density bonusing in zoning bylaws.
The deadline to make changes to zoning bylaws from the Province is by June 30, 2026, that all existing density bonus zones either be made compliant with Bill 13 through submission of extensive, site-specific, financial analyses, or be amended to remove the bonus provision.
At this time, the Cowichan Valley Regional District (CVRD) is only removing density bonusing provisions and is not undertaking financial feasibility work related to density bonusing or inclusionary zoning, to ensure compliance with the new provincial framework.
Previously, the CVRD (and any local government in B.C.) could work with developers to allow for extra units, height, or floor area in exchange for public benefits (such as park land, park improvements, civic facilities, or affordable housing). The CVRD has density bonusing provisions in 12 zones within Electoral Areas B, C, D (Upland), E, F, G & H and is now required to update its bylaws to remove these provisions.
